This agreement is between Kiddos Play Center, LLC, located at 309 Main St N, Carthage, TN 37030 ("Company"), and the undersigned renter ("Renter"). By signing, Renter agrees to take full responsibility for the safe use of the bounce house ("Equipment") and understands the risks involved.
Assumption of Risk & Liability Release
Using a bounce house comes with risks such as falls, collisions, equipment failure, or weather-related hazards. Renter agrees to use the Equipment safely, supervise all participants, and inspect it upon delivery, reporting any issues immediately. Renter assumes full responsibility for injuries or damages and releases Kiddos Play Center, LLC, its owners, employees, and volunteers from any liability, including claims of negligence, except for cases of gross negligence or intentional harm.
Renter Responsibilities
Renter is solely responsible for ensuring all safety guidelines are followed, including those posted on the Equipment. Kiddos Play Center, LLC is not responsible for injuries resulting from failure to follow these rules.
Keep the Equipment in its original location. Moving or altering it makes Renter responsible for any damages or injuries.
Remove shoes, sharp objects, and hazardous items before entering.
Ensure an adult supervises at all times.
Stop use immediately if winds exceed 15 mph, it starts raining, or lightning occurs.
Return the Equipment in its original condition. Cleaning or repair fees may apply if excessively dirty, wet, or damaged.
Pay for any damage beyond normal wear and tear, including full replacement if needed.
Follow all posted rules and safety guidelines on the bounce house.
Follow weight limits strictly. No adults may jump with children, and total weight capacity must not be exceeded.
Liability, Insurance & Third-Party Claims
Kiddos Play Center, LLC does not provide medical insurance. Renter understands that Kiddos Play Center, LLC is not responsible for any medical expenses incurred due to injuries sustained during Equipment use.
Kiddos Play Center, LLC is not responsible for injuries due to improper use, lack of supervision, or weather conditions. Renter agrees to indemnify, defend, and hold harmless Kiddos Play Center, LLC, its owners, employees, and volunteers from any claims, lawsuits, damages, or legal fees arising from Equipment use, including but not limited to injuries, property damage, and third-party claims. Renter agrees to indemnify and hold harmless Kiddos Play Center, LLC from any third-party claims, including those from guests, event attendees, or property owners.
Cancellations & Refunds
If you need to cancel or reschedule, please call at least 48 hours in advance to receive a full refund. Cancellations made after this timeframe are non-refundable. If rescheduling due to severe weather, please notify us at least 24 hours in advance. Kiddos Play Center, LLC will handle refunds and rescheduling on a case-by-case basis.
Dispute Resolution
Any disputes must be settled through binding arbitration in Smith County, Tennessee, under Tennessee law. By signing, Renter waives the right to file a lawsuit against Kiddos Play Center, LLC.
Agreement Terms
This agreement follows Tennessee law. Any changes must be in writing and signed by both parties. If any section is invalid, the remaining terms will still apply.
